After considering the queries, clarifications, recommendations, and suggestions, the BAC4IGOV hereby decides to include, revise, amend, delete, and/or adapt the following provisions:

Please kindly consider to accept audited Financial Report 2012 and 2013 instead of 2014. NEC Philippine’s parent company is NEC Corporation located at Japan and their fiscal year is from April to March. As subsidiary company of NEC Corporation, NEC Philippine needs to follow Japan’s fiscal year rule. Therefore the delay to issue audited financial report is inevitable situation for us. Thus, please kindly confirm whether audited Financial Report 2012 and 2013 can be accepted instead of 2014.  

According to the Implementing Rules and Regulations of the Republic Act 9184, Section 23.1 (a)(vi), “Audited financial statements, stamped “received” by the Bureau of Internal Revenue (BIR) or its duly accredited and
authorized institutions, for the preceding calendar year,
which should not be earlier than two (2) years from bid
Submission” is part of the Eligibility Requirements.

 

We would like to reiterate that only audited financial statements for the preceding calendar year, which should not be earlier than two (2) years from bid Submission will be accepted.

 

 

 

This is a mandatory requirement that must be complied with by prospective bidders, such that failure to submit any of the documents or the submission of an otherwise incomplete or patently insufficient document will disqualify the bidder based on the non-discretionary pass/fail criterion under Section 30.1 of the IRR.

Schedule of Requirements
Please kindly consider to change deliver schedule of goods, software, NW design, training from 45 days to 90 days after Notice To Proceed. 45 days is not enough lead time to deliver because it require lead time of manufacturing of product, shipping from oversea, inland transportation etc. Delivery Schedule is changed from 45 to 90 days.

We understand maintenance should be out of schedule requirements. So we understand Scope of Work is as stated in the separate sheet of “SOW DOST-NEC”. Is our understanding correct? Yes, it is out of the schedule of requirements as the timeline for maintenance period starts after the acceptance date.

May we understand the Evidence of “statement of all its ongoing”(Annex-I) is required to submit only when bidder is announced as LCB?(at the stage of post-qualification?)  

Submission of Statement of all its Ongoing Contract (Annex-I) is required. The Purchase Orders or Contracts as listed per submitted Annex-I shall be presented within the non-extendible period of three (3) calendar days from the receipt of the Notice of Singe/Lowest Calculated Bid (S/LCB).

May we understand the Evidence of “Statement of Completed Single Largest Contract” is required to submit only when bidder is announced as LCB? (at the stage of post-qualification?)  

Submission of Statement of Single Largest Completed Contract of Similar in Nature within the Last Five Years from Date of Submission and Receipt of Bids Amounting to at Least Fifty Percent of the ABC (Annex-IA) is required. Copy of End User’s Acceptance or Copy of Official Receipt/s as listed per submitted Annex-IA shall be presented within the non-extendible period of three (3) calendar days from the receipt of the Notice of Singe/Lowest Calculated Bid (S/LCB).

May I understand it’s not regarded as a subcontracting if local company who was authorized by NEC Philippine by issuing certificate of distributorship join to this tender as main bidder? It is not regarded as subcontracting as long as the local company will join this tender as main bidder.

Yes, authentication is only required when the sourced document is not written in English.

If sourced document is not written in English, an accurate translation in English must be provided together with a certification from the appropriate embassy or consulate in the Philippines.

If sourced document is already translated in English, the said translation should be certified/attested by the appropriate government office/agency.

No need to attach documents. Only the Statement of Compliance for Section VII. The Brochure (original or internet download) / Technical Data Sheet or equivalent document shall be presented within the non-extendible period of three (3) calendar days from the receipt of the Notice of Singe/Lowest Calculated Bid (S/LCB).

May I understand NMS is DOST scope as far as it doesn’t require additional NMS for SDN? Please kindly confirm.  

DOST has an existing NMS (http://www.cacti.net/). It uses SNMP to poll monitoring data from devices and applications. If the solution can use SNMP MIBs then no additional monitoring is needed.

May I understand delivery of materials, such as Power supply and rack and its installation is DOST’s scope?
May I understand DOST prepares cables between racks, and NEC prepares cables inside the rack?
Please kindly confirm.
Outside network cable will be provided by DOST, in-rack cabling will be provided by the bidder. Power sockets will be provided by DOST while power cables should be provided by bidder.

As for the requirement “performance of supervision of on-site assembly and/or start-up of the supplied Goods” in page 74, DOST will require as far as it’s not plug-on ready product. This is just for products requiring assembly on site. Like installation of hard disk, power supplies or additional modules.

May we understand the payment term stated on 11.2 is subject to not only for goods, but also delivery of Software, Network Design, Training and Maintenance? Please kindly confirm. Yes, the payment terms shall cover the goods and services specified in the Technical Specifications.

May we understand the condition of acceptance is the completion of delivering Software, Network Design and Training? Acceptance condition should be discussed with the winning bidder. But initially acceptance will depend on the timeliness of the products and services to be delivered.
22 If only one bidder participate in this tender, the tender is still valid? Yes.
23 Is there contract negotiation process after announcing LCB? There is no contract negotiation in the procurement of goods and services as per RA 9184.

Can we have Contract Agreement before submission of tender documents?  

No, Contract Agreement will be done after the bidder has been declared as Single/Lowest Calculated and Responsive Bidder (S/LCRB).

All terms, conditions and instructions to bidders specified in the Bidding Documents inconsistent with this Bid Bulletin are hereby superseded and modified accordingly.
