This Supplemental Bid Bulletin No. 4 is issued to modify or amend items in the Bidding Documents specifically on Instruction to Bidders. This shall form as integral part of the Bid Documents.

Positive agreement to a technical requirement / specification must be supported by evidence in a bidder’s bid and cross-referenced to that evidence.

 

Lest that is not supported by evidence or is subsequently found to be contradicted by the evidence presented will render the Bid under evaluation liable for rejection.

 

A statement either in the Bidders statement of compliance or the supporting evidence that is found to be false either during Bid evaluation, post-qualification or the execution of the Contract may be regarded as fraudulent and render the Bidder or supplier liable for prosecution subject to the provisions of ITB 3.1 and/or GCC Clause 2.1. Section VII. Technical Specifications

ANNEX B

SMA TENDER BID SUBMISSION FORM

INSTRUCTION TO BIDDERS:

  1. All filled in values on these should have NO erasures.
  2. Fill-in values in Tables 1, 1.1 and 1.2 with the monetary offer information.

NOTE: All Monthly Service Fee (MSF) values will be considered authoritative and binding over all other figures provided. BIDDERS are strongly encouraged to provide accurate calculations of the Total Annual Fee values and the Total Offer value however in case of errors the MSF values offered shall still be considered binding and valid.

  1. An OFFERED MSF cannot exceed the Maximum MSF value provided. The Total Offer cannot exceed the Maximum Offer (ABC). Violation of either of these will disqualify the entire BID. BIDDERS may submit non-compliant bids that may be considered should the bidding fail twice and a negotiated bid method be employed.
  2. BIDDERS should indicate through Table 2, in the column “Bidder Agrees To”, the bidder must indicate positive agreement/ disagreement in the appropriate YES/NO box, respectively. Marking of BOTH shall be considered a “YES” reply

  1. All pages should be stapled together. The DOST ICTO shall dry seal all pages together simultaneously upon opening and checking that there are no erasures on any of the pages. This shall ensure all pages submitted by a bidder are attributable to it. Bidders are encouraged to take similar measures such as affixing their signature on each page in the spaces provided.

As part of the Bid Evaluation process, the information, proof and pieces of evidence to be provided shall be used to verify critical capabilities of the Service for a responsive bid. DOST ICTO reserves the right to require additional information and evidence, where failure to comply shall be grounds for bid disqualification

Evidence shall be submitted for compliance during the bid submission. Emphasis should be given to showing fitness and fulfillment to requirements of the Service outlined in Table 2: AGREEMENT TO MEET REQUIREMENTS/ CONDITIONS), and all other documents related to this tender.

The information, proof and evidence to be provided by the BIDDER shall be in the form of manufacturer’s un-amended sales, product literature, unconditional statements of specification and compliance issued by the manufacturer, samples, independent test data etc., as appropriate.

Should there be discrepancy/ies found during post-qualification on the bidder’s representation of positive agreement and actual offer vis-a-viz the un-amended sales literature, unconditional statements or specification and compliance issued by the manufacturer or distributor, the same shall be enough basis for disqualification.
