After considering the queries, clarifications, recommendations and suggestions, the BAC4IGOV hereby decides to include, revise, amend, delete and/or adapt the following provisions:

1 This is in reference for the NGDC1 & NGDC3 SBB #5 which you released last April 25 (NGDC1) and April 26 (NGDC3) under the Revised Bid Data Sheet, Letter K.

 

In was stated that you require “Safety Officer with COSH and BOSH certifications”

 

But in the April 26 REFERENCE TABLE OF BID COMPLIANCE (in Excel format), it was changed into:

 

Copies of COSH OR BOSH Certification of the Vendor’s Safety Officer

 

Which one should we follow? Please advise

The requirement is “Copies of COSH and BOSH Certification of the Vendor’s Safety Officer” as stated in Section VII. Technical Specifications.

 

Please use the Revised Reference Table of Bid Compliance as of 9 May 2017 attached in this Supplemental Bid Bulletin.

2 For the NGDC3 under Item 9.4 FS Scope of Services, specification from the Reference Table of Bid Compliance, it was stated that the Bidder shall supplier pre-action fire sprinklers to non-critical areas.  However, upon checking on the Revised Technical Specification, the said requirement was not part of it. The specifications was altered after the pre-bid conference so there’s no way for us to clarify this. The requirement under Item 9.4 FS Scope of Services in the Reference Table of Bid Compliance is removed. Please refer to the Revised Reference Table of Bid Compliance as of 15 May 2017.
3 Also, for NGDC3, aside from the REFERENCE TABLE OF BID COMPLIANCE, are we going to include too the REVISED SPECIFICATIONS AS OF 26 APRIL 2017 in the submittals and write “COMPLY” on the left side? Since the NGDC1 has two sets of Compliance Table (The one on the Excel file and the REVISED TECHNICAL SPECIFICATIONS AS OF 25 APRIL 2017) Please submit signed Section VI. Specifications as part of the Technical Documents. In addition, please use the Revised Reference Table of Bid Compliance as attached in this Supplemental Bid Bulletin.
4 In reference to the NGDC1 Revised Checklist of Requirements, the Revised Technical Specification was included. However, in the NGDC3, the Revised Specification and even the Original Specification enclosed in the Bid Docs, were not included in the NGDC3 Revised Checklist. We then assumed that the said NGDC3 files are part of the Post-Qualifications. However, upon reviewing the post-qual requirements, it was not included too.

 

Question: what is the final document that we should include in the submittals for the NGDC3 Technical Specifications? Is it the REFERENCE TABLE OF BID COMPLIANCE (in Excel) or the Revised Specification (even without the column where we should write comply)? Or both?

Please submit signed Section VI. Specifications as part of the Technical Documents. While in the Reference Table of Bid Compliance, only reference per specification shall be stated. Please use the Revised Reference Table of Bid Compliance as attached in this Supplemental Bid Bulletin.
5 Also, please take a second look for the line item WLD-FDAS-PA TABLE to avoid technical problem later on especially on the side of the commercial cost. They are included in the BOQ but the item is ”zero”. Please see attached file for the screenshot.

The items marked with “0” quantities literally means no quantity or no item is required. Those 2 items were included as a validating statement that typical components such as those (often asked about by contractors) which usually are found in fire protection designs, are not literally needed for this project as per developed conceptual designs.

Section I. Invitation to Bid
4. A prospective Bidder should have completed within the last five (5) years from the date of submission and receipt of bids at least one (1) single contract of similar nature amounting to at least fifty percent (50%) of the ABC OR at least two (2) contracts of similar nature, the aggregate amount of which should be equivalent to at least fifty (50%) of the ABC, the largest of these contracts must be equivalent to at least twenty five (25%) of the ABC.

 

For this project, “similar in nature” shall mean “Data Center Turnkey Engagement”.

4. A prospective Bidder must have an experience of having completed a Single Largest Completed Contract (SLCC) that is similar to this Project, equivalent to at least fifty percent (50%) of the ABC.

 

For this project, “similar in nature” shall mean “Data Center Turnkey Engagement.”

Section III. Bid Data Sheet

12.(a)(iii)

iii. The Bidder must have completed, within the last five (5) years from the date of submission and receipt of at least one (1) single contract of similar nature amounting to at least fifty percent (50%) of the ABC OR at least two (2) contracts of similar nature, the aggregate amount of which should be equivalent to at least fifty (50%) of the ABC, the largest of these contracts must be equivalent to at least twenty five (25%) of the ABC.

 

 

Certified true copy of any of the following documents or its equivalent must be attached to Annex I-A:

a)        Notice of Award and/or Notice to Proceed

b)        Project Owner’s Certificate of Final Acceptance issued by the Owner other than the Contractor

c)        Constructor’s Performance Evaluation System (CPES) Final Rating Sheet which must have a satisfactory rating

 

iii. Statement of Completed Single Largest Contract that is similar in nature equivalent to at least fifty percent (50%) of the ABC adjusted, if necessary, by the Bidder to current process using the Philippine Statistics Authority (PSA) consumer price index.

 

Certified true copy of any of the following documents or its equivalent must be attached to Annex I-A:

a)        Notice of Award and/or Notice to Proceed;

b)        Project Owner’s Certificate of Final Acceptance issued by the Owner other than the Contractor; or

c)        Constructor’s Performance Evaluation System (CPES) Final Rating Sheet which must have a satisfactory rating

 

*In case of contracts with the private sector, an equivalent document shall be submitted.

Section III. Bid Data Sheet

12.(a)(vi)

vi. For Joint Ventures, Bidder to submit either:

1.     Copy of the JOINT VENTURE AGREEMENT (JVA) in case the joint venture is already in existence, or

2.     Copy of Protocol / Undertaking of Agreement to Enter into Joint Venture signed by all the potential join venture partners stating that they will enter into and abide by the provisions of the JVA in the instance that the bid is successful. (Annex III)

The JVA or the Protocol/Undertaking of Agreement to Enter into Joint Venture (Annex III) must include/specify the company/partner and the name of the office designated as authorized representative of the Joint Venture.

For Joint Venture, the following documents must likewise be submitted:

For Joint Venture Between Two (2) Local Companies, each partner should submit: PhilGEPS Certificate of Registration and Membership in accordance with Section 8.5.2 of the IRR, except for foreign bidders participating in the procurement by a Philippine Foreign Service Office or Post, which shall submit their eligibility documents under Section 23.1 of the IRR, provided, that the winning bidder shall register with the PhilGEPS in accordance with section 37.1.4 of the IRR.

vi. For Joint Ventures, Bidder to submit:

1.     Copy of the JOINT VENTURE AGREEMENT (JVA) in case the joint venture is already in existence; and

2.     A valid special PCAB License in case of joint ventures, and registration for the type and cost of the contract for this Project.

For Joint Venture, the following documents must likewise be submitted:

For Joint Venture Between Two (2) Local Companies, each partner should submit: PhilGEPS Certificate of Registration and Membership in accordance with Section 8.5.2 of the IRR, except for foreign bidders participating in the procurement by a Philippine Foreign Service Office or Post, which shall submit their eligibility documents under Section 23.1 of the IRR, provided, that the winning bidder shall register with the PhilGEPS in accordance with section 37.1.4 of the IRR.

c)     Bank Draft / Guarantee or Irrevocable Letter of Credit issued by a Universal or Commercial Bank equivalent to at least 2% of the ABC: Provided, however, that it shall be confirmed or authenticated by a Universal or Commercial Bank, if issued by a foreign bank

d)    Surety Bond callable upon demand issued by a surety or insurance company duly certified by the Insurance Commission as authorized to issue such security equivalent to at least 5% of the ABC
