2.11 Reserve Cloud Resources – All Cloud Infrastructure offered must be reserved and prepaid by the winning bidder for 3 (three) years upon issuance of Notice to Proceed. Provided that cloud service for years 2 and 3 shall be at no cost to DICT. The Winning Bidder must issue a certification to this effect and the reservation must reflect in DICT’s Cloud Control Panel and Dashboard. |

4. Highly Available Infrastructure |

4.1 The Cloud Service provider must have the capability to deploy DICT’s applications as a Highly Available solution across multiple datacenters in the same country. The solution must also include Disaster Recovery within the same country due to applicable laws and regulations. This capability will be to prevent any single points of failure due to geographical or natural disaster. Furthermore, DICT prefers its data to be stored in countries near the Philippines thus the Cloud Service Provider must have multiple datacenters located in countries that is a member state of the International Telecommunications Union in Region 3.
Note: The bidder must provide a certification coming from the Cloud Service Provider that states the presence of these datacenters at these regions. This certification must be presented during Bid Opening. |

5.1 The Cloud Service Provider must have the ability to provide a managed relational database service which can integrate with the chosen software solutions. This managed relational database will allow DICT administrators to optimize their time by “outsourcing” the Database patching and High Availability failover requirements to the Cloud Service Provider. |

14. Longevity of Cloud Service Provider and Third-Party Vetting |

14.1 Due to the nature of the Technology industry, DICT will only accept Cloud Service Providers which are vetted in the laaS Magic Quadrant for at least the past six (6) years. This is due to worries that technology providers may go out-of-business and thus cease support for the cloud service provided. 14.1 Due to the nature of the Technology industry, DICT will only accept Cloud Service Providers which are vetted by a tech analyst firm for more than five (5) years. This is to ensure that technology providers continued provision throughout the contract. |

The project plan shall be the basis for managing the project, although it shall usually need to be modified along the way to address changing business requirements and subject for DICT approval. The project plan includes, among others, the following components: |

42.1 The winning bidder shall be required to commit a 99.995% Service Level to ensure that there shall be no disruption to normal operations which may cause tangible and/or intangible damages. As such, should the vendor is not able to meet the required SLA, said vendor shall reimburse DICT with Service Credits for future work to be done or extension of its contractual engagement whichever is acceptable to DICT. The winning bidder shall propose its Service Credit Structure in accordance with the penalty intent and DICT shall review accordingly |

42.2 The winning bidder shall propose a service credit structure. This will enable the DICT to have the flexibility to change it in case the vendor’s proposed structure is better than what DICT had previously thought of. 43. Delivery Site: All hardware and software deliverables, as defined in this TOR, shall be delivered at DICT’s Primary Data Center Staging Area located at DICT Central Office, Diliman Quezon City. The vendor shall initially install required software and perform start-up configuration, and prepare this hardware/software for DICT Inspection. Upon completion of Inspection, the vendor shall be responsible in transporting equivalent of 8 sets of equipment (to be identified by DICT representative) to DICT Filed Operations Offices (FOO), specifically located at the following areas:
